AN ACT TO CREATE NEW SECTION 7-7-38, MISSISSIPPI CODE OF 1972, TO REQUIRE THAT AGENCIES ACQUIRING COMPUTER EQUIPMENT OR SERVICES WITH AN AGGREGATE COST OF $1,000,000.00 OR MORE SHALL DRAW ALL PAYMENTS FOR THE EQUIPMENT OR SERVICES FROM A SINGLE FUND IN THE STATE TREASURY; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The following shall be codified as Section 7-7-38, Mississippi Code of 1972:

7-7-38. (1) Whenever any agency of state government engages in the acquisition of computer equipment or services as defined in Section 25-53-3, with an aggregate cost of One Million Dollars ($1,000,000.00) or more, all payments and purchases associated with the project, from any major object of expenditure, shall be drawn from a single fund established in the State Treasury.

(2) The State Fiscal Officer shall not approve the payment of any funds for the acquisition of computer equipment or services for any agency unless the payments are drawn on the single fund in the State treasury established under the provisions of subsection (1) of this section.

(3) For purposes of this section, the term "payments and purchases associated with the project" means any payment of funds to any person, firm, or entity, public or private, for any equipment, service, or other thing of value that was necessary to the successful accomplishment of the acquisition of the computer equipment or services.

SECTION 2. This act shall take effect and be in force from and after July 1, 2000.
