AN ACT TO ESTABLISH THE MUNICIPAL CRIME PREVENTION FUND; TO PROVIDE THAT THE FUND SHALL BE ADMINISTERED BY THE DEPARTMENT OF PUBLIC SAFETY; TO PROVIDE THAT THE DEPARTMENT SHALL DISTRIBUTE MONIES FROM THE FUND TO EACH MUNICIPALITY IN THE STATE; TO SPECIFY THE PURPOSES FOR WHICH MUNICIPALITIES MAY EXPEND THE FUNDS RECEIVED FROM THE DEPARTMENT; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) There is created within the State Treasury a special fund to be known as the Municipal Crime Prevention Fund. The Department of Public Safety shall distribute monies out of the fund to each municipality in this state on a per capita basis, using the population figures from the most recent federal decennial census; however, no municipality shall receive less than Five Thousand Dollars ($5,000.00) from the fund. Funds received by municipalities under this section may be expended for, without limitation, any of the following purposes:

(a) Law enforcement;

(b) Equipment, technology, supplies, contractual services, including training and related travel, and commodities;

(c) State or federal crime prevention grant matching requirements; and

(d) Any crime prevention programs implemented by more than one (1) jurisdiction, which may include the State of Mississippi and any of its agencies, departments or political subdivisions, through the use of interlocal cooperation agreements.

(2) This section shall stand repealed on June 30, 2003.

SECTION 2. This act shall take effect and be in force from and after its passage.
