AN ACT MAKING AN APPROPRIATION FOR THE SUPPORT AND MAINTENANCE OF THE ALCORN STATE UNIVERSITY AGRICULTURAL PROGRAMS FOR FISCAL YEAR 1999.  

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State General Fund not otherwise appropriated, for the support and maintenance of the Alcorn State University Agricultural Programs for the fiscal year beginning July 1, 1998, and ending

June 30, 1999 $ 2,210,584.00.

SECTION 2. The following sum, or so much thereof as may be necessary, is hereby authorized for expenditure out of any special source funds which are collected by or otherwise become available, for the support and maintenance of the Alcorn State University Agricultural Programs for the fiscal year beginning July 1, 1998, and ending June 30, 1999 $ 2,031,523.00.

SECTION 3. Of the funds appropriated in Section 2, the following amounts shall be derived from the Education Enhancement Fund as follows:

(a) Twenty-two Thousand Two Hundred Seven Dollars

($22,207.00) shall be derived from funds deposited

pursuant to Sections 27-65-75 and 27-67-31, Mississippi

Code of 1972.

(b) Two Million Nine Thousand Three Hundred Sixteen Dollars

($2,009,316.00) shall be derived from funds deposited

pursuant to Section 27-103-203(1), Mississippi Code of

1972.

SECTION 4. Of the funds appropriated under the provisions of Sections 1 and 2, the following amounts, or so much thereof as may be necessary shall be expended for the purposes hereinafter set forth:

(a) For the support of the Small Farm Development Center at Alcorn State University, the sum of $ 536,165.00

(b) For the support of the Cooperative Extension Program services provided by Alcorn State University, the sum of

$ 458,540.00

(c) For the support of the Agriculture and Forestry Experiment Station services provided by Alcorn State University, the sum of $ 271,862.00

(d) For the support of the Swine Development Center, the sum of $ 260,395.00

(e) For the support of the Mississippi River Research Center services provided by Alcorn State University, for the sum

of $ 51,012.00

(f) For the support of the Small Farm Development Center, Goat Research and Marketing and other agricultural activities and programs at Alcorn State University, the sum of

$ 2,664,133.00.

SECTION 5. No general funds authorized to be expended herein shall be used to replace federal funds and/or other special funds which are being used for salaries which are withdrawn and no longer available.

SECTION 6. It is the intention of the Legislature that the agency's budget request for Fiscal Year 2000 shall be submitted to the Joint Legislative Budget Committee in a format and level of detail comparable to the format and level of detail provided during the Fiscal Year 1999 budget request process.

SECTION 7. Should revenues generated and deposited to the Education Enhancement Fund pursuant to Section 27-103-203(1), Mississippi Code of 1972, fall below funds appropriated herein from said source, the Board of Trustees of State Institutions of Higher Learning shall notify the Department of Finance and Administration as to which allotments shall be reduced to insure

that expenditures do not exceed actual revenues.

SECTION 8. In addition to all other funds heretofore appropriated, the following sum or so much thereof as may be necessary, is hereby appropriated out of any money deposited in the State Treasury from the Mississippi Tobacco Pilot Program as authorized in the case Mike Moore Attorney General ex rel. State of Mississippi v. The American Tobacco Company et al. (Chancery Court of Jackson County, Mississippi, Cause No. 94-1429) to the Mississippi Cooperative Extension Service for the fiscal year beginning July 1, 1998, and ending June 30, 1999

$ 100,000.00.

SECTION 9. The money herein appropriated shall be paid by the State Treasurer out of any money in the State Treasury to the credit of the proper fund or funds as set forth in this act, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

SECTION 10. This act shall take effect and be in force from and after July 1, 1998.
