AN ACT TO AUTHORIZE THE CITY OF GREENVILLE, WASHINGTON COUNTY, MISSISSIPPI, TO CONVEY TO THE DEPARTMENT OF ARCHIVES AND HISTORY THE REAL PROPERTY KNOWN AS THE "WINTERVILLE INDIAN MOUNDS STATE PARK" LOCATED IN WASHINGTON COUNTY, MISSISSIPPI, TO BE MANAGED BY THE DEPARTMENT OF ARCHIVES AND HISTORY IN ACCORDANCE WITH ITS POWERS AND DUTIES; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The City of Greenville, Washington County, Mississippi, is authorized to convey to the Department of Archives and History the real property known as the "Winterville Indian Mounds State Park" located in Washington County, Mississippi, to be managed by the Department of Archives and History in accordance with its powers and duties under Section 25-55-9, Mississippi Code of 1972. Such real property is more particularly described as follows:

Beginning at an iron pipe incased in concrete 27.87 chains on the Section line Westerly from the corner of Sections 17, 18, 19 and 20, Township 19N., Range 8W., which Section corner is marked by a lettered concrete monument established by Alton B. Clark and B.B. Carmichael; thence, to the left 90 degrees 00 minutes from said Section line, 18.48 chains; thence, to the left 90 degrees 00 minutes 9.98 chains; thence, to the left 71 degrees 25 minutes 4.926 chains; thence, to the right 60 degrees 19 minutes 15.064 chains; to the center of a gravel road; thence, to the left 58 degrees 28 minutes along said gravel road 5.28 chains to its intersection with the western boundary line of the right of way of Mississippi Highway No. 1; thence, to the left 28 degrees 46 minutes along said right of way 6.091 chains; thence, to the left 84 degrees 40 minutes 27.87 chains to the point of beginning. The above described land being situate in Section 19 and part of 20, Township 19 N, Range 8 W., containing 40.94 acres, Washington County, Mississippi.

Beginning at the corner common to Section 17, 18, 19 and 20, Township 19 North, Range 8 West; thence South 85 degrees 25 minutes West along North line of Section 19, 1825.7 feet to point of beginning; thence South 4 degrees 35 minutes East 330.7 feet to the East boundary line of U.S. proposed highway No. 1 right-of-way; thence along said right-of-way North 26 degrees 25 minutes West 367.3 feet to the North Boundary of Section 19; thence North 85 degrees 25 minutes East along said Section line 133.4 feet to point of beginning, containing 0.58 acres, more or less, and being situated in the Northwest quarter of Northeast quarter of Section 19, Township 19 North, Range 8 West, Washington County, Mississippi.

(2) The conveyance of the real property described in subsection (1) shall be executed only if the Legislature appropriates in Fiscal Year 2001 to the Department of Archives and History the necessary funds for the supervision, management and control of the real property.

(3) Upon conveyance of the real property described in subsection (1), the lease executed on February 27, 1960, by the City of Greenville, Washington County, Mississippi, to the Department of Wildlife, Fisheries and Parks of such real property shall be terminated.

SECTION 2. This act shall take effect and be in force from and after July 1, 2000.
