AN ACT TO EXTEND LIMITED LIABILITY IMMUNITY TO PERSONS USING "BEST DEMONSTRATED AVAILABLE TECHNOLOGY" FOR THE MODIFICATION OF PHOSPHOGYPSUM INTO BENEFICIAL USES; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Any person using "Best Demonstrated Available Technology" for the treatment of or modification of phosphogypsum into beneficial uses that meet EPA standards for the protection of human health shall not be liable for environmental risks and damages if that person has used due care and diligence in the process.

SECTION 2. This act shall take effect and be in force from and after July 1, 1998.
