AN ACT TO REQUIRE THAT ALL OPERATORS OF SCHOOL DISTRICT-OWNED VEHICLES BE TESTED ANNUALLY TO RETAIN THE AUTHORITY TO OPERATE SUCH A VEHICLE; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. For purposes of this act, a district-owned vehicle is any vehicle which is owned by the school district and is used to transport students for school-related activities. An operator is defined as any person who is employed by the school district whose responsibility it is to transport students for school-related activities. A test is defined as being an actual driving test conducted by the Mississippi Highway Safety Patrol to insure compliance with the rules of road safety.

SECTION 2. All operators of school district-owned vehicles must be tested annually to retain the authority to operate such a vehicle.

SECTION 3. The school district by which the operator is employed will defray the cost of the road test and specify the test in the operator's job description.

SECTION 4. Failure of the operator or the school district to comply will result in the suspension of the operators' privileges and a fine of Five Hundred Dollars ($500.00) imposed on the district by which the operator is employed, to be enforced by the Department of Public Safety.

SECTION 5. This act shall take effect and be in force from and after July 1, 1998.
