AN ACT TO AUTHORIZE APPOINTING AUTHORITIES OF STATE AGENCIES TO INITIATE RECRUITMENT EFFORTS FOR STATE SERVICE POSITIONS IN RESPONSE TO CURRENT OR PROJECTED AGENCY STAFFING REQUIREMENTS; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The appointing authority of a state agency is authorized to initiate recruitment efforts for state service positions in response to current or projected agency staffing requirements. Once recruitment has begun, the appointing authority shall refer all prospective appointees to the board for examination. The board shall determine if the applicant meets the minimum qualifications for the position. If the applicant meets such minimum qualifications, the board shall examine the applicant; and if a passing grade is obtained, a certification shall be made to the appointing authority that the applicant is eligible for appointment to the position for which he is applying. The appointing authority shall be the sole judge as to which individuals so certified are employed.

SECTION 2. This act shall be codified as a separate code section within Chapter 9 of Title 25, Mississippi Code of 1972.

SECTION 3. This act shall take effect and be in force from and after July 1, 1998.
