AN ACT TO AUTHORIZE THE ADJUTANT GENERAL TO ESTABLISH A PILOT PROGRAM WITH SIX COUNTIES AND MUNICIPALITIES TO USE MILITARY POLICE IN DRUG INTERDICTION AND COUNTER-DRUG ACTIVITIES WITHIN SUCH COUNTIES AND MUNICIPALITIES; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The Adjutant General is hereby authorized and empowered to execute an agreement with not more than six (6) counties and municipalities in the aggregate to establish pilot projects utilizing Mississippi National Guard military police in drug interdiction and counter-drug activities within such counties and municipalities. Agreement between the Adjutant General and any county or municipality to implement such projects shall be by an interlocal agreement pursuant to the Interlocal Cooperation Act of 1974. Any county or municipality, through its governing authority and with the approval of the sheriff with respect to counties and the chief of police with respect to municipalities, may, subject to any restrictions imposed by the governing authority, confer the powers of peace officers upon military police participating in law enforcement activities pursuant to agreements made under this section.
SECTION 2. This act shall take effect and be in force from and after its passage.
