AN ACT TO AMEND SECTION 25-1-17, MISSISSIPPI CODE OF 1972, TO REVISE THE NOMINAL OBLIGEE OF CERTAIN OFFICIAL BONDS; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 25-1-17, Mississippi Code of 1972, is amended as follows:

[Until January 1, 1999, this section shall read as follows:

25-1-17. The bonds of all public officers and public employees required to give bond shall be made payable to the state, and shall be put in suit in the name of the state for the use and benefit of any person injured by the breach thereof. Such bonds shall not be void on the first recovery, but may be put in suit from time to time by any party injured by the breach thereof, until the whole penalty shall be recovered.

[From and after January 1, 1999, this section shall read as follows:]

25-1-17. The bond of all county and municipal officers and employees required to give bond shall be made payable to the political subdivision, and shall be put in suit in the name of the political subdivision for the use and benefit of any person injured by the breach thereof. The bonds of all other public officers and public employees required to give bond shall be made payable to the state, and shall be put in suit in the name of the state for the use and benefit of any person injured by the breach thereof. Such bonds shall not be void on the first recovery, but may be put in suit from time to time by any party injured by the breach thereof, until the whole penalty shall be recovered.

SECTION 2. This act shall affect only those bonds made or entered into from and after the effective date.

SECTION 3. This act shall take effect and be in force from and after January 1, 1999.
