AN ACT TO DESIGNATE A CERTAIN ADDITIONAL SECTION OF HIGHWAY IN COAHOMA COUNTY AS A PART OF THE STATE HIGHWAY SYSTEM; TO PLACE IT UNDER THE JURISDICTION OF THE STATE TRANSPORTATION COMMISSION; TO PROVIDE THAT A CERTAIN SEGMENT OF MISSISSIPPI 304 IN TUNICA AND DESOTO COUNTIES WHICH WAS DELETED FROM THE STATE HIGHWAY SYSTEM IN 1996 SHALL BE DESIGNATED AS A STATE HIGHWAY AND PLACED UNDER THE JURISDICTION OF THE MISSISSIPPI TRANSPORTATION COMMISSION FOR CONSTRUCTION AND MAINTENANCE; TO PROVIDE THAT AFTER THE DATE THAT RELOCATED MISSISSIPPI 304 IN TUNICA AND DESOTO COUNTIES IS COMPLETED AND OPENED FOR TRAFFIC UNDER THE GAMING COUNTIES INFRASTRUCTURE PROGRAM THE OLD SEGMENT OF MISSISSIPPI 304 SHALL BE DELETED FROM THE STATE HIGHWAY SYSTEM AND RETURNED TO THE JURISDICTION OF THE BOARDS OF SUPERVISORS OF TUNICA AND DESOTO COUNTIES FOR MAINTENANCE; TO DESIGNATE A CERTAIN ADDITIONAL SECTION OF HIGHWAY IN LAWRENCE COUNTY AS A PART OF THE STATE HIGHWAY SYSTEM AND PLACE IT UNDER THE JURISDICTION OF THE MISSISSIPPI TRANSPORTATION COMMISSION; TO DELETE A CERTAIN SECTION OF HIGHWAY IN LAWRENCE COUNTY FROM THE STATE HIGHWAY SYSTEM AND REMOVE IT FROM THE JURISDICTION OF THE MISSISSIPPI TRANSPORTATION COMMISSION; AND FOR RELATED PURPOSES.  

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The mileage of highway specifically designated in this section is in addition to the total mileage limitation of eight thousand six hundred (8,600) miles which is set out in Section 65-3-3, Mississippi Code of 1972.

(2) The following highway is hereby designated as a state highway and shall be placed under the jurisdiction of the State Transportation Commission for construction and maintenance as hereinafter provided; and such highway, together with the highways designated in Sections 65-3-3 and 65-3-5, Mississippi Code of 1972, and any and all other laws adding links to the designated state highway system, are declared to be the state highway system of Mississippi:

NORTHERN DISTRICT - COAHOMA COUNTY:

That section of road extending westerly from Highway 315 to the intersection of US Highway 49 and MS Highway 61 near the Town of Rich.

(3) After the above-described section of road is brought up to state highway standards by the Board of Supervisors of Coahoma County, including a bypass around the Town of Rich and an approach to the intersection of MS Highway 49 and MS Highway 61, the State Transportation Commission is hereby authorized to maintain, take over and assume jurisdiction of the above-designated highway in the same manner and upon the same terms and conditions as set out in Sections 65-1-75, 65-3-3, 65-9-1 and 65-9-3, Mississippi Code of 1972.

SECTION 2. (1) The mileage of highway specifically designated in subsection (2) of this section is in addition to the total mileage limitation of eight thousand six hundred (8,600) miles that is set out in Section 65-3-3.

(2) The following segment of highway, which was deleted from the state highway system by Section 3(1) of Chapter 497, Laws of 1996 (Section 65-3-121(1), Mississippi Code of 1972), is designated as a state highway and returned to the jurisdiction of the Mississippi Transportation Commission for construction and maintenance; and such highway, together with the highways designated in Sections 65-3-3 and 65-3-5, and all other laws adding links to the designated state highway system, are declared to be the state highway system of Mississippi:

NORTHERN DISTRICT - TUNICA AND DESOTO COUNTIES

Mississippi 304 - Beginning at U.S. 61, Tunica County, and thence running in an easterly direction to or near Banks, Eudora and Hernando.

(3) The segment of highway described in subsection (2) of this section shall be deleted from the state highway system, removed from the jurisdiction of the Mississippi Transportation Commission and returned to the jurisdiction of the Boards of Supervisors of Tunica and DeSoto Counties from and after the date that relocated Mississippi 304 is completed and opened to traffic under the provisions of Section 65-39-1(2)(f).

SECTION 3. (1) (a) The mileage of highway specifically designated in this subsection (1) is in addition to the total mileage limitation of eight thousand six hundred (8,600) miles that is set out in Section 65-3-3.

(b) The following highway is designated as a state highway and is placed under the jurisdiction of the Mississippi Transportation Commission for construction and maintenance; and such highway, together with the highways designated in Sections 65-3-3 and 65-3-5, and all other laws adding links to the designated state highway system, are declared to be the state highway system of Mississippi:

SOUTHERN DISTRICT - LAWRENCE COUNTY

Commence at the intersection of Arm Road and S.R. 43 in Section 5, Township 6 North, Range 20 West, Lawrence County, Mississippi, and proceed northwesterly for approximately four (4) miles along Arm Road until its present intersection with US 84 in Section 24, Township 7 North, Range 21 West.

(c) The Mississippi Transportation Commission may maintain, construct, take over and assume jurisdiction of the highway designated in this subsection (1) in the same manner and upon the same terms and conditions as set out in Sections 65-1-75, 65-3-3, 65-9-1 and 65-9-3.

(2) The following highway is hereby deleted from the state highway system, removed from the jurisdiction of the Mississippi Transportation Commission and returned to the jurisdiction of the Board of Supervisors of Lawrence County:

SOUTHERN DISTRICT - LAWRENCE COUNTY

Commence at the intersection of Arm Road and S.R. 43 in Section 5, Township 6 North, Range 20 West, Lawrence County, Mississippi, and run northeasterly along S.R. 43 for approximately two (2) miles to the limit of State maintenance in Section 28, Township 7 North, Range 20 West.

SECTION 4. This act shall take effect and be in force from and after its passage.
