AN ACT TO AMEND SECTIONS 5-1-1 AND 5-1-3, MISSISSIPPI CODE OF 1972, TO REDUCE THE SIZE OF THE LEGISLATURE BEGINNING WITH THE REAPPORTIONMENT OR REDISTRICTING OF THE LEGISLATURE WHICH IS BASED UPON THE FEDERAL DECENNIAL CENSUS FOR THE YEAR 2000; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 5-1-1, Mississippi Code of 1972, is amended as follows:

5-1-1. (1) Except as otherwise provided in this section, the number of Representatives shall be one hundred twenty-two (122) * * *.

(2) In any reapportionment or redistricting of the Legislature based upon the federal decennial census for the year 2000, the number of Representatives shall be one hundred fifteen (115).

(3) In any reapportionment or redistricting of the Legislature based upon the federal decennial census for the year 2010, the number of Representatives shall be one hundred seven (107).

(4) * * * In any reapportionment or redistricting of the Legislature based upon the federal decennial census for the year 2020 or any decennial census thereafter, the number of Representatives shall be ninety-nine (99).

SECTION 2. Section 5-1-3, Mississippi Code of 1972, is amended as follows:

5-1-3. (1) Except as otherwise provided in this section, the number of Senators shall be fifty-two (52) * * *.

 * * *

(2) In any reapportionment or redistricting of the Legislature based upon the federal decennial census for the year 2000, the number of Senators shall be forty-nine (49).

(3) In any reapportionment or redistricting of the Legislature based upon the federal decennial census for the year 2010, the number of Senators shall be forty-five (45).

(4) * * * In any reapportionment or redistricting of the Legislature based upon the federal decennial census for the year 2020 or any federal decennial census thereafter, the number of Senators shall be forty-one (41).

SECTION 3. The Attorney General of the State of Mississippi is hereby directed to submit this act, immediately upon approval by the Governor, or upon approval by the Legislature subsequent to a veto, to the Attorney General of the United States or to the United States District Court for the District of Columbia in accordance with the provisions of the Voting Rights Act of 1965, as amended and extended.

SECTION 4. This act shall take effect and be in force from and after the date it is effectuated under Section 5 of the Voting Rights Act of 1965, as amended and extended.
