A RESOLUTION TO CREATE A NEW HOUSE RULE TO PROHIBIT SMOKING IN THE HOUSE CHAMBER OR THE HOUSE GALLERY WHILE THE HOUSE IS IN DAILY SESSION; TO ALLOW THE HOUSE MANAGEMENT COMMITTEE TO DESIGNATE SMOKING AREAS IN THE HOUSE CHAMBER; AND TO ALLOW HOUSE COMMITTEES THE OPTION OF DEVELOPING SMOKING POLICIES REGARDING THEIR COMMITTEE ROOMS.  

BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF MISSISSIPPI, That the Rules of the House are amended by creating a new rule to read as follows:

"_____. Smoking shall not be permitted in the House chamber or the House gallery during any daily session of the House from the time the session is convened until the time the session is adjourned; however, the House Management Committee may designate certain locations within the House chamber as smoking areas. The room adjacent to the House chamber, which commonly is referred to as the "cloakroom," and the members' restrooms adjacent to the House chamber, are not considered a part of the House chamber under this rule. Each House committee has the option to develop a policy regarding smoking in the room in which the committee meets. As used in this rule, "smoking" means to inhale, exhale, burn, carry or otherwise possess any lighted cigarette, cigar, pipe or any other object or device of any form that contains lighted tobacco or any other smoking product. The Sergeant-at-Arms shall enforce the provisions of this rule."

BE IT FURTHER RESOLVED, That in recognition of this House's respect for the health care of all Mississippians, this resolution is hereby adopted in memory of the late Representative Bill Richardson, who died of lung cancer in March 1997.
