AN ACT TO AMEND SECTION 55-3-61, MISSISSIPPI CODE OF 1972, TO REVISE THE LIMIT THAT A BOARD OF SUPERVISORS MAY DONATE TO A STATE PARK LOCATED WITHIN THE COUNTY; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

 

SECTION 1. Section 55-3-61, Mississippi Code of 1972, is amended as follows:

55-3-61. The board of supervisors of any county where a state park is located may, in its discretion, appropriate and donate to the Department of Wildlife, Fisheries and Parks yearly a sum not to exceed Five Thousand Dollars ($5,000.00) out of the general county fund for the establishment, maintenance and support of the state park within that county. All money appropriated and donated by the board of supervisors * * * shall be used for the establishment, maintenance and support of the state park within such county and for no other purpose.

The board of supervisors of any county lying wholly within a levee district, and having two (2) judicial districts, bordering on the Mississippi River and wherein Highway 61 and Highway 8 intersect, is authorized, in its discretion, to expend funds from the general fund of the county for the establishment, maintenance and support of a state park within that county to be located upon lands situated adjacent to the Mississippi River and lying west of the mainline Mississippi River levee within that county. * * * In addition * * *, the board is authorized, in its discretion, to expend county or supervisors district road maintenance and construction funds for the construction and maintenance of roads leading to and across the lands upon which the park is to be located.

SECTION 2. This act shall take effect and be in force from and after July 1, 1998.
