AN ACT TO PROVIDE FOR THE TERMINATION OF SIXTEENTH SECTION LAND LEASES UPON THE CONVICTION OF THE LEASEHOLDER OF A VIOLATION OF THE UNIFORM CONTROLLED SUBSTANCES LAW; TO PROHIBIT THE SCHOOL BOARD FROM LEASING SUCH LANDS TO PERSONS WHOSE PRIOR SIXTEENTH SECTION LEASEHOLDS HAVE BEEN TERMINATED FOR SUCH REASONS; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Upon the conviction of a holder of any lease executed under this chapter of a violation of the Uniform Controlled Substances Law, the school board shall initiate legal proceedings to terminate the lease. When the lease has been terminated, the sixteenth section or lieu lands shall become available for lease. However, the school board may not lease the sixteenth section or lieu lands to any person who previously has held a lease on sixteenth section or lieu lands which was terminated due to the conviction of that person of a violation of the Uniform Controlled Substances Law.

SECTION 2. Section 1 of this act shall be codified as a separate section in Chapter 3, Title 29, Mississippi Code of 1972.

SECTION 3. This act shall take effect and be in force from and after July 1, 1998.
