AN ACT TO CREATE A MUNICIPAL CRIME PREVENTION FUND UNDER THE DEPARTMENT OF PUBLIC SAFETY; TO PROVIDE THAT THE MUNICIPAL CRIME PREVENTION FUND SHALL BE ADMINISTERED BY THE DEPARTMENT OF PUBLIC SAFETY; TO PROVIDE THAT THE DEPARTMENT OF PUBLIC SAFETY SHALL DISTRIBUTE THE FUNDS TO MUNICIPALITIES AND COUNTIES ON A PER CAPITA BASIS; TO SET OUT WHAT THE FUNDS MAY BE EXPENDED FOR; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. There is hereby created the Municipal Crime Prevention Fund and it shall be administered by the Department of Public Safety. The department shall distribute the funds deposited into the Municipal Crime Prevention Fund by legislative appropriation to municipalities and counties in the state on a per capita basis, using the population figures from the most recent federal decennial census, with no municipality or county receiving less than One Thousand Dollars ($1,000.00) or more than Five Hundred Thousand Dollars ($500,000.00). Funds distributed to municipalities and counties by the department may be expended for, but not limited to, the following purposes:
(a) Law enforcement;
(b) Equipment, technology, supplies, contractual services, including training and related travel, and commodities;
(c) State or federal crime prevention grant matching requirements; and
(d) Any crime prevention programs implemented by more than one (1) jurisdiction, which may include the State of Mississippi and any of its agencies, departments or political subdivisions, through the use of interlocal cooperation agreements.
As used in this section, the term "crime prevention" means any program, activity or project undertaken by a municipality or county, or through interlocal cooperation with the State of Mississippi or any of its agencies, departments or political subdivisions, to reduce the incidence of crime within the municipal corporate limits.
SECTION 2. This act shall take effect and be in force from and after July 1, 1998.
