AN ACT TO REQUIRE A CERTAIN PERCENTAGE OF ALL COUNTY AD VALOREM TAX COLLECTIONS ON REAL PROPERTY LOCATED WITHIN A MUNICIPALITY OF THE COUNTY TO BE EXPENDED BY THE COUNTY ON ROADS, BRIDGES OR OTHER GOVERNMENTAL SERVICES WITHIN THAT MUNICIPALITY OR TO BE TRANSFERRED EACH FISCAL YEAR BY THE BOARD OF SUPERVISORS TO SUCH MUNICIPALITY AND DEPOSITED IN THE GENERAL FUND FOR EXPENDITURE FOR ANY PURPOSES FOR WHICH MONIES IN THE GENERAL FUND OF A MUNICIPALITY ARE AUTHORIZED BY LAW TO BE EXPENDED; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Not less than twenty-five percent (25%) of all county ad valorem tax collections on real property located within a municipality of the county (a) shall be expended by the county on roads, bridges or other governmental services within that municipality or, (b) at the discretion of the board of supervisors of the county, shall be transferred each fiscal year by the board of supervisors to such municipality and deposited in the general fund of the municipality for expenditure by the governing authorities of the municipality for any purposes for which monies in the general fund of a municipality are authorized by law to be expended.

SECTION 2. This act shall take effect and be in force from and after October 1, 1998.
