AN ACT TO ALLOW THE STATE FORESTRY COMMISSION TO SELL CERTAIN LAND LOCATED IN GEORGE COUNTY, MISSISSIPPI; TO PROVIDE THAT THE REVENUE DERIVED FROM THE SALE IS TO BE DEPOSITED INTO A SPECIAL FUND FOR USE BY THE MISSISSIPPI FORESTRY COMMISSION; TO AUTHORIZE THE MISSISSIPPI FORESTRY COMMISSION, THROUGH THE DEPARTMENT OF FINANCE AND ADMINISTRATION, TO CONVEY CERTAIN REAL PROPERTY TO ISSAQUENA COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The Mississippi Forestry Commission, through the Department of Finance and Administration and upon meeting the requirements of Section 29-1-1, may sell a ten-acre parcel of land located in George County, Mississippi, the property being more particularly described as follows:

S 1/2 of NE 1/4 of SE 1/4 of NE 1/4 and S 1/2 of NW 1/4 of SE 1/4 of NE 1/4 of Section Three (3), Township Two (2) South, Range Seven (7) West.

(2) Before the Mississippi Forestry Commission may sell the real estate described in subsection (1) of this section, the fair market value of the real estate shall be determined by averaging at least two (2) appraisals done by Mississippi certified general appraisers. The cost of the appraisals shall be paid for by the commission out of any monies appropriated for such purposes by the Legislature or any monies derived from other sources.

SECTION 2. The proceeds derived from the sale of the land described in Section 1 of this act shall be deposited into a special fund in the State Treasury to be used by the Mississippi Forestry Commission as appropriated by the Legislature.

SECTION 3. For the consideration of Ten Thousand Dollars ($10,000.00), the Mississippi Forestry Commission, through the Department of Finance and Administration, and upon meeting the requirements of Section 29-1-1, may convey certain state-owned real property located in Issaquena County, Mississippi, to Issaquena County, Mississippi, the property being more particularly described as follows:

TRACT NO. 11

A tract or parcel of land lying and being situated in the SW 1/4 SE 1/4 of Section 6, Township 12 North, Range 7 West, Issaquena County, Mississippi, more particularly described as follows:

Beginning at a point located 50 feet landward of the intersection of the center line of Mississippi State Highway No. 14 and the right descending top bank of Steele Bayou, said point of beginning being also located on the boundary of right-of-way previously acquired by the Board of Mississippi Levee Commissioners for Steele Bayou Channel Improvement, Item ST-46; run thence with said right-of-way boundary in a general Southwesterly direction for a distance of 430 feet, more or less; thence N.23N31'E., 300 feet, more or less, to a point located in the center of Mississippi State Highway No. 14; run thence with the center of said highway in an Easterly direction for a distance of 210 feet, more or less, to the point of beginning, containing 0.50 acre, more or less; and as shown on map prepared by the U.S.A., Engineer District, Vicksburg, File No. YS-15-19, R/W, Drawing No. 7.

EAST TRACT

Beginning at a point in the Southeast Quarter of Section 6, Township 12 North, Range 7 West, said point being where the center line of Mississippi Highway 14 intersects the center line of the Steele Bayou Channel Improvement; thence Westerly following the center line of said Highway 14, two hundred eighty (280) feet to the West boundary of the Steele Bayou Channel Improvement right-of-way; thence at right angles to said Highway 50 feet to the South right-of-way of Highway 14; thence Southwesterly following the West right-of-way of the Steele Bayou Channel Improvement 678.6 feet; thence East to the top bank of Steele Bayou; thence Northeasterly following the top bank of said Bayou 678.6 feet, more or less to the South right-of-way of Mississippi Highway 14; thence Westerly following the South right-of-way of Mississippi Highway 14 to the point of beginning, lying and being situate in the Southeast Quarter of Section 6, Township 12 North, Range 7 West, Issaquena County, Mississippi.

WEST TRACT

Beginning at a point in the Southeast Quarter of Section 6, Township 12 South, Range 7 West, said point being where the center line of Mississippi Highway No. 14 intersects the center line of the East prong of Steele Bayou; thence Westerly following the center line of said Mississippi Highway No. 14 a distance of 200 feet; thence at right angles to the said Highway 14 Southerly 50 feet to the South right-of-way of said Highway 14, and the point of beginning of the lot herein conveyed; thence Westerly following the South right-of-way of said Highway 14 a distance of 600 feet; thence South 625 feet; thence East 200 feet, more or less, to the right-of-way of the Steele Bayou Channel Improvement; thence following the West right-of-way of said Steele Bayou Channel Improvement in a Northeasterly direction 678.6 feet, more or less, to the South right-of-way of the said Mississippi Highway No. 14 and the point of beginning, containing 5.6 acres, more or less, and situate in the Southeast Quarter of Section 6, Township 12 North, Range 7 West, Issaquena County, Mississippi.

SECTION 4. The State of Mississippi shall retain all mineral rights to the state-owned real property conveyed pursuant to Section 3 of this act.

SECTION 5. The proceeds derived from the sale of the land described in Section 3 of this act shall be deposited into a special fund in the State Treasury to be used by the Mississippi Forestry Commission as appropriated by the Legislature.

SECTION 6. This act shall take effect and be in force from and after July 1, 1998.
