AN ACT TO AMEND SECTION 63-1-37, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT A PERSON WHOSE DRIVER'S LICENSE WAS REVOKED, SUSPENDED OR CANCELLED SHALL NOT BE CHARGED A FEE FOR THE ISSUANCE OF A DUPLICATE DRIVER'S LICENSE IF, UPON REINSTATEMENT OF HIS DRIVING PRIVILEGES, HIS ORIGINAL DRIVER'S LICENSE HAS NOT EXPIRED; AND FOR RELATED PURPOSES.  

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 63-1-37, Mississippi Code of 1972, is amended as follows:

63-1-37. In the event that a license or temporary driving permit issued under the provisions of this article is lost or destroyed, the licensee shall obtain from the commissioner a duplicate copy thereof and shall pay a fee in the amount of Five Dollars ($5.00) therefor. Said license or permit shall be marked "Duplicate."

No person whose driver's license was revoked, suspended or cancelled shall be charged a fee under this section for the issuance of a duplicate driver's license if, at the time of application for a duplicate license, such person is eligible for reinstatement of his driver's license and driving privileges and the original license of such person has not expired.

SECTION 2. This act shall take effect and be in force from and after July 1, 1998.
