AN ACT TO AUTHORIZE THE BOARD OF TRUSTEES OF STATE INSTITUTIONS OF HIGHER LEARNING, THROUGH THE DEPARTMENT OF FINANCE AND ADMINISTRATION, TO SELL AND CONVEY CERTAIN STATE-OWNED REAL PROPERTY LOCATED IN BOLIVAR COUNTY, MISSISSIPPI, TO THE OFFEROR OF THE HIGHEST AND BEST PRICE FOR THE LAND; TO REQUIRE THREE APPRAISALS OF THE REAL ESTATE BEFORE IT IS PURCHASED; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The Board of Trustees of State Institutions of Higher Learning, through the Department of Finance and Administration and upon meeting the requirements of Section 29-1-1, may sell and convey to the offeror of the best price, any or all of the parcel of land described in this act which has been determined to be not needed in the operation of Delta State University. The land being described as follows:

Lot Six, Block Eighteen of College Heights Addition to the City of Cleveland, according to a map or plat of said Addition on file in the office of the Clerk of the Chancery Court of Bolivar County in Cleveland, Mississippi, together with all improvements thereon and all easements and appurtenances thereunto pertaining.

SECTION 2. The Department of Finance and Administration shall advertise for bids on the property described in Section 1 of this act for at least three (3) consecutive weeks in at least one (1) newspaper having a general circulation in Bolivar County. The date as published for the bid opening shall not be less than five (5) working days after the last published advertisement. The advertisement shall state the time and place at which bids shall be received and shall describe the property to be sold. If there is no newspaper published in the county, then notice shall be given by posting the advertisement at the courthouse in the county and at two (2) other public places in the county. The property shall be sold to the offeror of the highest and best price for the property, but the consideration shall not be less than the average of the fair market price for the tract as determined by three (3) Mississippi certified general appraisers selected by the Department of Finance and Administration.

SECTION 3. The State of Mississippi shall convey all mineral rights to the real property purchased pursuant to Section 1 of this act.

SECTION 4. The proceeds from the sale and conveyance of the real property described in Section 1 of this act shall be deposited into the State General Fund.

SECTION 5. This act shall take effect and be in force from and after its passage.
