AN ACT TO AMEND SECTION 25-1-17, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT THE BONDS OF ALL PUBLIC OFFICERS AND PUBLIC EMPLOYEES REQUIRED TO GIVE BOND SHALL BE MADE PAYABLE TO THE COUNTY OR MUNICIPAL GOVERNING AUTHORITY EMPLOYING THE OFFICER OR EMPLOYEE; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 25-1-17, Mississippi Code of 1972, is amended as follows:

25-1-17. The bonds of all public officers and public employees required to give bond shall be made payable to the county or municipal governing authority employing the officer or employee, and shall be put in suit in the name of such county or municipal governing authority for the use and benefit of any person injured by the breach thereof. Such bonds shall not be void on the first recovery, but may be put in suit from time to time by any party injured by the breach thereof, until the whole penalty shall be recovered.

SECTION 2. This act shall take effect and be in force from and after July 1, 1998.
