AN ACT TO CREATE A NEW CODE SECTION TO BE CODIFIED IN CHAPTER 7 OF TITLE 85, MISSISSIPPI CODE OF 1972, TO PROVIDE A LIEN ON PACKAGED OR CONDENSING UNITS; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Any person who sells or repairs any external packaged or condensing unit which provides more than 18,000 BTU of cooling capacity shall have a lien on such unit until the purchase price or repair costs shall be paid. Any unit which can be removed from a dwelling or other structure without causing damage to the unit or structure is subject to repossession within ninety (90) days after failure of payment as provided by law. The lienholder may repossess such unit after a third notice if a constable assists the lienholder.

SECTION 2. Section 1 of this act shall be codified as a separate code section in Chapter 7, Title 85, Mississippi Code of 1972.

SECTION 3. This act shall take effect and be in force from and after July 1, 1998.
