Senate Concurrent Resolution 516

A CONCURRENT RESOLUTION PROPOSING AN AMENDMENT TO THE MISSISSIPPI CONSTITUTION OF 1890 BY CREATING A NEW SECTION TO PROVIDE FOR A STATE BOARD OF DENTURITRY; TO PROVIDE FOR THE DUTIES AND POWERS OF THE BOARD; AND TO MANDATE A MONEY BACK WARRANTY ON DENTURES FURNISHED BY DENTURISTS. 

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendment to the Mississippi Constitution of 1890 is proposed to the qualified electors of the state:

Amend the Mississippi Constitution of 1890 by adding the following section:

SECTION ____. (1) There is hereby created the Mississippi Board of Denturitry which shall consist of five (5) members appointed by the Governor. The initial appointments shall be from the state at large and for a term of three (3) years. Thereafter the term shall be three (3) years with one (1) member appointed from each of the congressional districts. Four (4) members shall be appointed from the membership of the Mississippi Denturists Association and one (1) member shall be a consumer at least sixty-five (65) years of age.

(2) The Mississippi Board of Denturitry shall have the following powers and duties:

(a) To determine the qualifications of persons applying for licenses;

(b) To issue licenses for the practice of denturitry;

(c) To make rules and regulations to regulate the practice of denturitry;

(d) To collect fees and charges to cover the operating expenses of the board as may become necessary from time to time; and

(e) To exercise any and all powers necessary to carry out its duties.

(3) Practice of denturitry means the making, placing, constructing, altering, reproducing or repairing a removable denture; and the taking impressions and furnishing or supplying a removable denture directly to a person or advising the use of a removable denture and maintaining a facility for such practice.

(4) Any person receiving the services of a denturist shall be entitled to a ninety-day, one hundred percent (100%) money back warranty on all removable dentures furnished by the denturist.

BE IT FURTHER RESOLVED, That this amendment shall be submitted to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 1997 in the manner provided by the Constitution and by law.

BE IT FURTHER RESOLVED, That the explanation of the amendment for the ballot read as follows: "This amendment creates a Board of Denturitry which would regulate the practice of denturitry and mandate a 100% money back warranty on dentures furnished by denturists."
