AN ACT MAKING AN ADDITIONAL APPROPRIATION OF STATE GENERAL FUNDS TO THE OFFICE OF THE ATTORNEY GENERAL FOR THE PURPOSE OF DEFRAYING THE COSTS OF CERTAIN OUTSIDE LEGAL ASSISTANCE AND EXPERT WITNESS FEES, JUDGMENTS AND SETTLEMENT AGREEMENTS INCURRED BY THE OFFICE OF THE ATTORNEY GENERAL AND AGAINST THE STATE OF MISSISSIPPI FOR FISCAL YEAR 1997. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State General Fund not otherwise appropriated, for the purpose of defraying the expenses of the Office of the Attorney General for the fiscal year ending June 30, 1997 $ 48,151.00.

This additional appropriation is made for the purpose of defraying the costs of certain outside legal assistance, court costs and expert witness fees incurred by the Office of the Attorney General.

SECTION 2. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State General Fund not otherwise appropriated, for the purpose of paying a settlement and dismissal of action against the State of Mississippi for the fiscal year ending June 30, 1997

$ 15,000.00.

This additional appropriation is made for the purpose of paying a court-ordered settlement as required in Civil Action No. 5:95-CV-135(BR) (S). Steven Rance Smith v. Glen Arnold, individually and in his official capacity as Captain of the Wilkinson County Community Work Center of the Mississippi Department of Corrections, in the United States District Court for the Southern District of Mississippi; Western Division.

SECTION 3. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State General Fund not otherwise appropriated, for the purpose of paying overtime, attorneys' fees and the expenses in Supreme Court Case #93-CC-0069, Mississippi Highway Safety Patrol v. Robert T. McFadden, in the Supreme Court of the State of Mississippi, for the fiscal year ending June 30, 1997 $ 24,446.00.

SECTION 4. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State General Fund not otherwise appropriated, for the purpose of paying a settlement and dismissal of action against the State of Mississippi in the United States District Court for the Northern District of Mississippi, Eastern Division, Civil Action No. 1:96-CV-311(D)(D), Billy S. Tigrett v. Maurice "Mo" Graddy, in his individual capacity, and David Smith d/b/a Smith's Auto Repair and Sale, for the fiscal year ending June 30, 1997

$ 10,000.00.

SECTION 5. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State General Fund not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi, for the fiscal year ending June 30, 1997 $ 47,316.00.

This additional appropriation is made for the purpose of paying a court-ordered judgment as required in Civil Action No. 3:94-CV-411 WS, David Ingrebretsen and ACLU of Mississippi, et al. v. Jackson Public School District and Attorney General Mike Moore, in the United States District Court, Southern District of Mississippi.

SECTION 6. The money herein appropriated shall be paid by the State Treasurer out of any money in the State General Fund not otherwise appropriated, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers, in the manner provided by law.

SECTION 7. This act shall take effect and be in force from and after its passage.
