AN ACT TO AMEND CHAPTER 960, LOCAL AND PRIVATE LAWS OF 1995, AS AMENDED, TO AUTHORIZE THE BOARD OF SUPERVISORS OF TUNICA COUNTY TO PAY AN AMOUNT OF MONEY TO THE INSTITUTE OF COMMUNITY SERVICES, INC., IN CALENDAR YEARS 1997, 1998 AND 1999 FOR THE CONSTRUCTION OF A NEW FACILITY FOR THE INSTITUTE OR TO RETIRE DEBTS RELATED THERETO; TO AUTHORIZE THE BOARD OF SUPERVISORS TO PAY TO THE INSTITUTE CERTAIN MONIES HELD BY THE COUNTY FOR SUCH NEW FACILITY; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Chapter 960, Local and Private Laws of 1995, as amended by Chapter 936, Local and Private Laws of 1996, is amended as follows:

Section 1. (1) The Board of Supervisors of Tunica County, Mississippi, is hereby authorized and empowered, in its discretion, to pay to the Institute of Community Services, Inc. (ICS, Inc.) out of any available county funds an amount not to exceed Fifty Thousand Dollars ($50,000.00) per year during calendar years 1997, 1998 and 1999 in order to assist ICS, Inc. with the construction of its new facility located within one (1) mile of the White Oak Subdivision in Tunica County or to assist ICS, Inc. in paying debts incurred in the construction of the new facility.

(2)(a) The board of Supervisors of Tunica County, Mississippi, is authorized, in its discretion, to deposit into an interest-bearing account a sum of money not exceeding Fifty Thousand Dollars ($50,000.00), from any available funds, for the purpose of providing local matching funds necessary for the construction of a new facility by the Institute of Community Services, Inc. ("ICS, Inc."), within one (1) mile of the White Oak Subdivision in Tunica County. Any interest earned on the account shall be paid into the general fund of Tunica County on a quarterly basis.

(b) In addition to the authority granted in paragraph (a) of this subsection, the Board of Supervisors of Tunica County is authorized to deposit an additional Fifty Thousand Dollars ($50,000.00) from any available funds, into the interest-bearing account described in paragraph (a) of this subsection for the purposes set forth in this section.

(3) From and after the effective date of Senate Bill No. 3085, 1997 Regular Session, the Board of Supervisors of Tunica County may pay to ICS, Inc., the One Hundred Thousand Dollars ($100,000.00) held by the county pursuant to subsection (2) of this section, which monies shall be expended in the construction of the new facility described in subsection (1) of this section or shall be expended to retire debt incurred in the construction of such new facility.

SECTION 2. This act shall take effect and be in force from and after its passage.
