AN ACT TO AMEND SECTION 11-35-61, MISSISSIPPI CODE OF 1972, TO AUTHORIZE GARNISHEES TO BE PAID $50.00 FOR THEIR ATTENDANCE IN A GARNISHMENT ACTION; AND FOR RELATED PURPOSES.  

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 11-35-61, Mississippi Code of 1972, is amended as follows:

11-35-61. The garnishee shall be allowed for his attendance, out of the debts or effects in his possession, or against the plaintiff in attachment, judgment or decree in case there be no debts or effects in his possession, provided he shall put in his answer within the time prescribed by law, Fifty Dollars ($50.00) and, in exceptional cases rendering it proper, the court may allow the garnishee reasonable compensation additional to the foregoing and to be obtained in the same way.

SECTION 2. This act shall take effect and be in force from and after July 1, 1997.
