AN ACT TO AMEND SECTION 45-37-5, MISSISSIPPI CODE OF 1972, TO DELETE THE PREEMPTION OF PROVISIONS OF THE "PREVENTION OF YOUTH ACCESS TO TOBACCO ACT OF 1994" OVER ANY LOCAL ORDINANCE OR REGULATION WHICH RELATES TO THE USE, SALE, PROMOTION AND DISTRIBUTION OF TOBACCO AND TOBACCO PRODUCTS; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 45-37-5, Mississippi Code of 1972, is amended as follows:

45-37-5. It is the intent of the Legislature that enforcement of this chapter shall be implemented in an equitable manner throughout the state. * * * It is the intent of the Legislature that this chapter be equitably enforced so as to ensure the eligibility for and receipt of any federal funds or grants that the State of Mississippi now receives or may receive relating to the provisions of this chapter.

SECTION 2. This act shall take effect and be in force from and after its passage.
