Senate Bill 2557

(As Passed the Senate)

AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF RANKIN COUNTY TO PERMIT THE CLOSING DURING CERTAIN HOURS OF CERTAIN COUNTY STREETS WHICH PROVIDE ACCESS TO RESIDENTIAL AREAS OR SUBDIVISIONS IN ORDER TO PREVENT INTERFERENCE WITH PROPERTY AND PRESERVE GOOD ORDER; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Notwithstanding any provision of Section 65-7-7, Mississippi Code of 1972, to the contrary, in order to prevent injury to, destruction of, or interference with private property and to preserve good order and peace within residential communities, the Board of Supervisors of Rankin County by order duly spread upon its minutes may authorize the closing during certain hours of county streets which provide access to clearly identifiable residential areas or subdivisions.

Before the authority granted by this act may be assumed by the board of supervisors, the board of supervisors shall adopt a resolution declaring its intention to assume such authority. Notice of such intention shall be published once each week for at least three (3) consecutive weeks in a newspaper having a general circulation in the county, the first publication of which shall be made not less than twenty-one (21) days before the date on which the board will begin to exercise the authority. If, within the time of giving notice, twenty percent (20%) or fifteen hundred (1500), whichever is less, of the qualified electors of the county file a written protest against the assumption of such authority, then the authority shall not be assumed by the board of supervisors unless authorized by a majority vote of the qualified electors of the county voting in an election to be called and held for that purpose.

SECTION 2. This act shall take effect and be in force from and after its passage.
