AN ACT TO AMEND SECTION 37-103-25, MISSISSIPPI CODE OF 1972, TO PRESCRIBE A METHOD OF CALCULATING NONRESIDENT FEES FOR UNIVERSITIES AND COMMUNITY AND JUNIOR COLLEGES; AND FOR RELATED PURPOSES.  

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 37-103-25, Mississippi Code of 1972, is amended as follows:

37-103-25. (1) The Board of Trustees of State Institutions of Higher Learning and the State Board for Community and Junior Colleges are hereby authorized to prescribe the amount of fees to be paid by students attending the several state-supported institutions of higher learning and community and junior colleges of the State of Mississippi. Rates to be paid by nonresidents of Mississippi shall annually be calculated by the boards for implementation at the beginning of the upcoming academic year, and the total fees charged a nonresident shall be at least the Southern Regional Education Board (SREB) nonresident average per student for the fiscal year immediately preceding that for which the fees are being recalculated. In so calculating fees for nonresidents at the various state-supported institutions in Mississippi, the boards of the several institutions shall set such fees for a particular institution on the basis of the SREB nonresident average per student for that type institution as differentiated from others and classified by the SREB.

(2) No nonresident may be counted by the Board of Trustees of State Institutions of Higher Learning or the State Board for Community and Junior Colleges for purposes of determining total credit hours generated in allocating funds from a funding formula.

SECTION 2. This act shall take effect and be in force from and after July 1, 1997.
