AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF HANCOCK COUNTY, MISSISSIPPI, TO LEVY AN ASSESSMENT, IN ADDITION TO ANY OTHER ASSESSMENTS AND COURT COSTS, FOR EACH MISDEMEANOR CASE PROCESSED THROUGH ITS JUSTICE COURT; TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF BAY ST. LOUIS, MISSISSIPPI, TO LEVY AN ASSESSMENT, IN ADDITION TO ANY OTHER ASSESSMENTS AND COURT COSTS, FOR EACH MISDEMEANOR CASE PROCESSED THROUGH ITS MUNICIPAL COURT; TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF WAVELAND, MISSISSIPPI, TO LEVY AN ASSESSMENT, IN ADDITION TO ANY OTHER ASSESSMENTS AND COURT COSTS, FOR EACH MISDEMEANOR CASE PROCESSED THROUGH ITS MUNICIPAL COURT; TO PROVIDE THAT THE AVAILS OF THE ADDITIONAL ASSESSMENT SHALL BE USED TO FUND AND OPERATE THE NEW COURT ANNEX, AND TO FUND AND OPERATE THE HANCOCK COUNTY YOUTH DETENTION CENTER; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The Board of Supervisors of Hancock County, Mississippi, in its discretion, by resolution duly adopted and entered on its minutes, may levy an assessment, in addition to any other assessments and court costs, not to exceed Five Dollars ($5.00) per case, for each misdemeanor case processed through the justice court of the county.

(2) Three Dollars ($3.00) of the avails of the additional assessment imposed pursuant to subsection (1) of this section shall be used to fund and operate the new court annex, which is located on Highway 90, in Hancock County, and formally known as the McDonald Building. Two Dollars ($2.00) of the avails of the additional assessment shall be used to fund and operate the Hancock County Youth Detention Center.

SECTION 2. (1) The governing authorities of the City of Bay St. Louis, Mississippi, in their discretion, by resolution duly adopted and entered on the minutes of the governing authorities, may levy an assessment, in addition to any other assessments and court costs, not to exceed Five Dollars ($5.00) per case, for each misdemeanor case processed through the municipal court of the municipality.

(2) Three Dollars ($3.00) of the avails of the additional assessment imposed pursuant to subsection (1) of this section shall be used to fund and operate the new court annex, which is located on Highway 90, in Hancock County, and formally known as the McDonald Building. Two Dollars ($2.00) of the avails of the additional assessment shall be used to fund and operate the Hancock County Youth Detention Center. The avails of the additional assessment shall be paid to the board of supervisors on or before the fifteenth day of the month following the month in which collected.

(1) The governing authorities of the City of Waveland, Mississippi, in their discretion, by resolution duly adopted and entered on the minutes of the governing authorities, may levy an assessment, in addition to any other assessments and court costs, not to exceed Five Dollars ($5.00) per case, for each misdemeanor case processed through the municipal court of the municipality.

(2) Three Dollars ($3.00) of the avails of the additional assessment imposed pursuant to subsection (1) of this section shall be used to fund and operate the new court annex, which is located on Highway 90, in Hancock County, and formally known as the McDonald Building. SECTION 4. This act shall take effect and be in force from and after its passage.
