AN ACT TO AMEND SECTION 2, CHAPTER 72, LAWS OF 1996, TO TRANSFER CERTAIN PORTIONS OF THE MONEY IN THE FISCAL YEAR 1997 APPROPRIATION TO THE STATE BOARD OF MEDICAL LICENSURE FROM ONE CATEGORY TO ANOTHER. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 2, Chapter 72, Laws of 1996, is amended as follows:

Section 2. Of the funds appropriated under the provisions of Section 1, not more than the amounts set forth below shall be expended for the respective major objects or purposes of expenditure:

Salaries, Wages and Fringe Benefits $ 587,285.00

Travel and Subsistence 27,500.00

Contractual Services 441,634.00

Commodities 33,235.00

Capital Outlay:

Other Than Equipment 0.00

Subsidies, Loans and Grants 100.00

Total $ 1,145,885.00

From the funds provided in the Major Object of Expenditure "Personal Services: Salaries, Wages and Fringe Benefits," funds may be expended for the following purposes, in compliance with policies established by the State Personnel Board and any conditions placed on such expenditures:

(a) The components of the Variable Compensation Plan shall be maintained within the constraints of the funds provided herein.

(b) No funds provided herein shall be expended within the In-service (COLA), Longevity, Productivity, Upward Reallocation or Realignment components of the Variable Compensation Plan, except as specified herein.

(c) In those cases where the State Personnel Board determines that a bona fide staffing need exists, funds may be expended for upward reallocations and realignments, but only upon written certification by the agency director and the State Fiscal Officer that adequate funds are available.

(d) Pursuant to policies established by the State Personnel Board, agency heads may, on a case by case basis and from within funds available, recommend equity salary adjustments. Such adjustments shall not be retroactive and may be made when an employee with greater or equal continuous state service experience and qualifications is being paid less than an employee working in the same job classification within the same agency.

It is the agency's responsibility to make certain that funds required to be appropriated for Personal Services for Fiscal Year 1998 do not exceed Fiscal Year 1997 funds appropriated for that purpose unless programs and/or positions are added to the agency's budget by the Mississippi Legislature.

Any transfers or escalations shall be made in accordance with the terms, conditions and procedures established by law.

No general funds authorized to be expended herein shall be used to replace federal funds and/or other special funds which are being used for salaries authorized under the provisions of this act and which are withdrawn and no longer available.

SECTION 2. This act shall take effect and be in force from and after its passage.
