House Bill 1344

AN ACT TO CREATE A NEW SECTION IN CHAPTER 5 OF TITLE 83, MISSISSIPPI CODE OF 1972, TO REQUIRE THAT IN ANY TYPE OF SUBROGATION CLAIM BY AN INSURANCE COMPANY, THE INSURANCE COMPANY SHALL PAY ITS PROPORTIONATE PART OF CERTAIN COSTS AND EXPENSES; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The following section shall be codified in Chapter 5 of Title 83, Mississippi Code of 1972:

In any type of subrogation claim by an insurance company, the insurance company shall pay its proportionate part of any reasonable costs and expenses incurred in connection therewith, including reasonable attorney's fees.

SECTION 2. This act shall take effect and be in force from and after July 1, 1997.
