AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO GRANT TO THE DEPARTMENT OF TRANSPORTATION FOR HIGHWAY PURPOSES PERPETUAL AND TEMPORARY EASEMENTS ON CERTAIN PARCELS OF PROPERTY LOCATED IN HINDS COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The Department of Finance and Administration may grant to the Department of Transportation, for highway purposes, a perpetual easement on one (1) parcel of property and a temporary easement on two (2) parcels of property, located in Hinds County, Mississippi, being more particularly described as follows:

PERPETUAL EASEMENT

Begin at a point that is 55 feet Northerly of and measured radially to the centerline of survey of Federal Aid Project No. 4600056-01-044-11 at survey Station 37+50; from said point of beginning run thence North 83 degrees 52 minutes East, a distance of 36.9 feet to a point that is 60 feet north of and perpendicular to the centerline of survey of said project at survey station 37+86.52; thence run North 88 degrees 39 minutes East, distance of 311.0 feet; thence run North 80 degrees 20 minutes East, a distance of 100.1; thence run North 85 degrees 04 minutes East, a distance of 211.7 feet to a point that is 95 feet Northerly of and perpendicular to the centerline of survey of said project at station 44+13.97; thence run North 86 degrees 58 minutes East along a line that is 95 feet Northerly of and parallel with the centerline of survey of said project, a distance of 208.3 feet; thence run North 89 degrees 42 minutes East, a distance of 280.1 feet; thence run Northeasterly along a line that is 85 feet Northerly of and parallel with the centerline of survey of said project, an arc distance of 358.2 feet; thence run South 89 degrees 45 minutes East, a distance of 45.9 feet to a point that is 85 feet Northerly of and parallel with the centerline of survey of said project, an arc distance of 358.2 feet; thence run South 89 degrees 45 minutes East, a distance of 45.9 feet to a point that is 85 feet Northerly of and perpendicular to the centerline of survey of said project at station 53+01.46; thence run Southeasterly along a line that is 85 feet Northerly of and parallel with the centerline of said project, an arc distance of 99.3 feet; thence run South 86 degrees 33 minutes East, a distance of 100.8 feet; thence run Southeasterly along a line that is 80 feet Northerly of and parallel with the centerline of survey of said project, an arc distance of 503.5 feet; thence run North 86 degrees 17 minutes East, a distance of 38.6 feet to the present Northwesterly right-of-way line of Mississippi No. 25; thence run South 3 degrees 49 minutes West, along said present Northwesterly right-of-way line of Mississippi No. 25, a distance of 25.0 feet to the present Northern right-of-way line of Mississippi No. 25; thence run Westerly along said present Northern right-of-way line of Mississippi Highway No. 25 as follows: Northwesterly, a distance of 740.4 feet; thence run South, a distance of 5.0 feet; thence run North 89 degrees 52 minutes West, a distance of 45.9 feet; thence run Northwesterly, an arc distance of 636.4 feet; thence run South 86 degrees 58 minutes West, a distance of 208.3 feet; thence run Southwesterly, an arc distance of 622.9 feet; thence run North 88 degrees 20 minutes West, a distance of 36.5 feet to the point of beginning, containing 58,962.0 square feet (1.35 acres), more or less.

TEMPORARY EASEMENT

Parcel No. 1

Begin at a point that is 60 feet Northerly of and perpendicular to the centerline of survey of Federal Aid Project No. 46-0056-01-044-11 at Survey Station 37+86.52; from said point of beginning run thence South 83 degrees 53 minutes West, a distance of 16.7 feet; thence North 1 degree 40 minutes East, a distance of 27.2 feet; thence run South 88 degrees 27 minutes East along a line that is 85 feet north of and parallel with the centerline of survey of said project, a distance of 59.5 feet; thence run South 1 degree 21 minutes West, a distance of 22.8 feet; thence run South 88 degrees 39 minutes West, a distance of 43.2 feet to the point of beginning, containing 1,463.0 square feet (0.03 acres), more or less.

Parcel No. 2

Beginning at a point that is 68.2 feet Northerly of and measured radially to the centerline of survey of Federal Aid Project No. 46-0056-01-044-11 at Survey Station 40+00; from said point of beginning run thence North 0 degrees 04 minutes West, a distance of 61.0 feet; thence run North 89 degrees 51 minutes East along a line that is 130 feet north of and parallel with the centerline of survey of said project, a distance of 57.0 feet; thence run South 0 degrees 23 minutes East, a distance of 60.6 feet; thence run South 88 degrees 39 minutes West, a distance of 59.5 feet to the point of beginning, containing 3,623.2 square feet (0.08 acres), more or less.

Parcel No. 1 and Parcel No. 2 contain an aggregate of 5,086.2 square feet (0.11 acres), more or less.

SECTION 2. This act shall take effect and be in force from and after its passage.
