AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO TRANSFER TO THE DEPARTMENT OF TRANSPORTATION CERTAIN REAL PROPERTY LOCATED IN JACKSON, MISSISSIPPI; TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO CONVEY TO BELHAVEN COLLEGE A CERTAIN PARCEL OF PROPERTY FRONTING THE NORTH SIDE OF RIVERSIDE DRIVE IN JACKSON, MISSISSIPPI, AND LYING BETWEEN THE PROPERTY CURRENTLY BEING USED FOR THE HEADQUARTERS OF THE MISSISSIPPI NATIONAL GUARD AND THE PROPERTY OWNED BY THE SALVATION ARMY; TO AUTHORIZE THE STATE FAIR COMMISSION, BY AND THROUGH THE DEPARTMENT OF FINANCE AND ADMINISTRATION AND UPON MEETING THE REQUIREMENTS OF SECTION 29-1-1, MISSISSIPPI CODE OF 1972, TO PURCHASE THAT PORTION OF THREE PARCELS OF REAL PROPERTY LOCATED ADJACENT TO THE STATE FAIRGROUNDS ON HIGH STREET IN JACKSON, MISSISSIPPI, WHICH IS REMAINING AFTER THE ACQUISITION BY THE CITY OF JACKSON, MISSISSIPPI, OF THE RIGHT-OF-WAY FOR THE WIDENING OF HIGH STREET; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The Department of Finance and Administration may transfer to the Department of Transportation, being the successor to the powers and duties of the Motor Vehicle Comptroller, that property, or portion thereof necessary for the operation of its calibrating station, dedicated to the Motor Vehicle Comptroller by the State Building Commission and situated between Mill Street and West Street in Jackson, Mississippi, more particularly described in State Building Commission Minute Book No. 15, Page 90, dated July 23, 1958, and State Building Commission Minute Book No. 30, Page 176, dated February 10, 1972.

SECTION 2. (1) The Department of Finance and Administration is authorized, in its discretion, to convey to Belhaven College a certain parcel of property fronting the north side of Riverside Drive in Jackson, Mississippi, and lying between the property currently being used for the headquarters of the Mississippi National Guard and the property owned by the Salvation Army, the specific legal description of such parcel to be determined by the Department of Finance and Administration. The Department of Finance and Administration is authorized to have such parcel of property surveyed in order to determine the specific legal description, but such parcel of property conveyed shall not exceed six hundred fifty (650) feet of depth.

(2) The real property described in subsection (1) of this section shall be sold for not less than the current fair market value as determined by the averaging of at least two (2) appraisals by qualified appraisers who are selected by the Department of Finance and Administration and are certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.

(3) Any funds received by the State of Mississippi for the conveyance of the real property described in subsection (1) of this section shall be deposited into the General Fund.

(4) The State of Mississippi shall retain all mineral rights to the real property sold pursuant to this section.

SECTION 3. (1) The State Fair Commission, by and through the Department of Finance and Administration and upon meeting the requirements of Section 29-1-1, Mississippi Code of 1972, is authorized to purchase that portion of three (3) parcels of real property located adjacent to the State Fairgrounds on High Street in Jackson, Mississippi, which is remaining after the acquisition by the City of Jackson, Mississippi, of the right-of-way for the widening of High Street.

(2) The real property described in subsection (1) of this section shall be purchased for not more than the current fair market value as determined by the averaging of at least two (2) appraisals by qualified appraisers who are selected by the Department of Finance and Administration and are certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.

SECTION 4. This act shall take effect and be in force from and after its passage.
