AN ACT TO AMEND SECTION 63-3-517, MISSISSIPPI CODE OF 1972, TO EXCLUDE UNMARKED LAW ENFORCEMENT VEHICLES FROM SPEED RESTRICTIONS; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 63-3-517, Mississippi Code of 1972, is amended as follows:

63-3-517. The speed limitations set forth in this article shall not apply to authorized emergency vehicles when responding to emergency calls and the drivers thereof sound audible signal by bell, siren, or exhaust whistle. The speed limitations set forth in this article shall not apply to unmarked vehicles used by law enforcement officers in the performance of law enforcement duties. This section shall not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the street, nor shall it protect the driver of any such vehicle from the consequence of a reckless disregard of the safety of others.

SECTION 2. This act shall take effect and be in force from and after July 1, 1997.
