AN ACT TO REQUIRE SCHOOL DISTRICTS TO PAY TO THE DEPARTMENT OF HUMAN SERVICES A STUDENT'S PRO RATA SHARE OF THE DISTRICT'S MINIMUM PROGRAM ALLOTMENT WHEN THAT STUDENT IS PLACED IN THE OAKLEY OR COLUMBIA TRAINING SCHOOL; TO PRESCRIBE A FORMULA FOR CALCULATING PAYMENTS BY SCHOOL DISTRICTS UNDER THIS ACT; TO REQUIRE THE DEPARTMENT OF HUMAN SERVICES TO ALLOCATE FUNDS RECEIVED UNDER THIS ACT TO THE RESPECTIVE TRAINING SCHOOLS FOR THE SUPPORT OF THE EDUCATIONAL PROGRAMS IN SUCH SCHOOLS; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) Whenever a student in a public school district is placed in the Oakley Training School or the Columbia Training School, the school district from which the student is removed shall pay to the Mississippi Department of Human Services an amount equal to the student's pro rata share of the school district's allotment under the Minimum Education Program for each day that the student is not in attendance in the school district due to his placement in the training school. The amount to be paid by the school district shall be equal to the school district's annual allotment under the Minimum Education Program divided by the number of students in average daily attendance in the school district, divided by the number of days in the school district's scholastic year, multiplied by the number of school days the student was not in attendance in the school district due to his placement in the training school. The school district shall remit payment for all amounts due to the Department of Human Services under this section before the fifth day of the month next succeeding each month that one or more students from that school district are not in attendance in the school district due to placement in the training school.

(2) The Department of Human Services shall allocate all funds received from a school district due to the placement of a student from that district in the Oakley or Columbia Training School to the training school in which the student has been placed. The funds shall be used solely for the purchase of educational materials and to support the educational programs in the training schools.

SECTION 2. This act shall take effect and be in force from and after July 1, 1997.
