AN ACT TO AMEND SECTION 75-31-6, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT THE STATE BOARD OF HEALTH SHALL ASSESS A CERTAIN PERMIT FEE ON PLANTS PROCESSING FROZEN DESSERTS; TO AMEND SECTION 75-31-47, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE STATE BOARD OF HEALTH TO PROMULGATE RULES AND REGULATIONS AND EXERCISE CONTROL OVER THE PROCESSING AND SALE OF FROZEN DESSERTS; TO REPEAL SECTIONS 75-31-125 THROUGH 75-31-151, WHICH PROVIDE FOR THE MISSISSIPPI FROZEN DESSERTS ACT OF 1982; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 75-31-6, Mississippi Code of 1972, is amended as follows:

75-31-6. The board shall assess fees in the following amount and for the following purpose:

Milk product processing plant annual

permit fee $150.00.

Frozen dessert processing plant annual

permit fee $50.00

The fees authorized under this section shall not be assessed for milk or frozen dessert processing plants operated by public schools, by public junior colleges or by state agencies or institutions, including without limitation, the State Institutions of Higher Learning.

SECTION 2. Section 75-31-47, Mississippi Code of 1972, is amended as follows:

75-31-47. The State Board of Health shall have supervision and administration over Sections 75-31-41 through 75-31-49 and is authorized to make such rules and regulations as may be necessary in order to carry out the provisions of Sections 75-31-41 through 75-31-49. The State Board of Health is authorized to promulgate rules and regulations and exercise control over the processing and sale of frozen desserts.

SECTION 3. Sections 75-31-125 through 75-31-151, Mississippi Code of 1972, which provide for the Mississippi Frozen Desserts Act of 1982, are repealed.

SECTION 4. This act shall take effect and be in force from and after July 1, 1997.
