AN ACT TO AMEND SECTION 99-38-5, MISSISSIPPI CODE OF 1972, TO CLARIFY THAT A PERSON CONVICTED OF A CRIME SHALL NOT PROFIT FROM SUCH CRIME; AND FOR RELATED PURPOSES. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 99-38-5, Mississippi Code of 1972, is amended as follows:

99-38-5. Every person, firm, corporation, partnership, association or other legal entity contracting with any person or the legal representative, assignee, beneficiary or heirs at law of any person accused or convicted of a crime in this state, with respect to the reenactment of such crime by way of a movie, book, magazine article, tape recording, phonograph record, photograph, reproduction, radio or television presentation, live entertainment of any kind, or from the expression of such accused or convicted person's thoughts, feelings, opinions or emotions regarding such crime, or any other plan to profit from such crime, shall submit a copy of such contract to the Treasurer and pay over to the Treasurer any monies which would otherwise, by the terms of such contract, be owing to the person so accused or convicted or his legal representative, assignee, beneficiary or heirs at law. The accused or convict or his legal representative, assignee, beneficiary or heirs at law are prohibited from receiving any monies related to such crime.

SECTION 2. This act shall take effect and be in force from and after July 1, 1997.
