AN ACT TO AMEND SECTION 99-7-15, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE BUREAU OF NARCOTICS TO SERVE CAPIAS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 99-7-15, Mississippi Code of 1972, is amended as follows:
99-7-15. An indictment returned into the clerk of the circuit court shall not be inspected by any person but the judge, clerk, district attorney, and sheriff, until the defendant shall have been arrested or has entered into bail or recognizance for the offense. When any indictment shall be based on a violation of the Uniformed Controlled Substance Law, if the matter has been investigated by the Mississippi Bureau of Narcotics, the senior bureau agent who investigated the case shall immediately be informed of the indictment by the district attorney and bureau agents may be tasked by the sheriff when making the arrest of the defendant.
SECTION 2. This act shall take effect and be in force from and after July 1, 1997.
