Title: AN ACT TO AMEND SECTION 41-7-191, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE ISSUANCE OF A HEALTH CARE CERTIFICATE OF NEED FOR NURSING FACILITY BEDS TO A NONPROFIT SKILLED NURSING FACILITY CONSTRUCTING A "GREEN HOUSE MODEL" CAMPUS TO BE LOCATED IN YAZOO CITY, MISSISSIPPI; TO AUTHORIZE THE ISSUANCE OF A HEALTH CARE CERTIFICATE OF NEED FOR ICFMR BEDS IN A COMMUNITY LIVING PROGRAM FOR DEVELOPMENTALLY DISABLED ADULTS TO BE LOCATED IN MADISON COUNTY, MISSISSIPPI; TO PROVIDE THAT THE REOPENING OF A HEALTH CARE FACILITY WHICH HAS CEASED TO OPERATE FOR 60 MONTHS REQUIRES A CERTIFICATE OF NEED; TO REVISE THE DEFINITION OF NEW HEALTH SERVICES REQUIRING A CERTIFICATE OF NEED; TO REVISE THE DEFINITION OF RELOCATION OF HEALTH SERVICES REQUIRING A CERTIFICATE OF NEED AND TO PROVIDE THAT THE REPLACEMENT OR RELOCATION OF A CRITICAL ACCESS HOSPITAL IS EXEMPT FROM CERTIFICATE OF NEED REVIEW; TO PROVIDE THAT THE STATE DEPARTMENT OF HEALTH SHALL ISSUE CERTIFICATES OF NEED TO THE OWNER OF A NURSING FACILITY IN OPERATION AT THE TIME OF HURRICANE KATRINA IN HANCOCK COUNTY THAT WAS NOT OPERATIONAL ON DECEMBER 31, 2005, BECAUSE OF DAMAGE SUSTAINED FROM HURRICANE KATRINA TO AUTHORIZE THE CONSTRUCTION OF A NEW NURSING FACILITY IN HARRISON COUNTY, THE RELOCATION OF FORTY-NINE NURSING FACILITY BEDS FROM THE HANCOCK COUNTY FACILITY TO THE NEW HARRISON COUNTY FACILITY, THE ESTABLISHMENT OF NOT MORE THAN TWENTY NON-MEDICAID NURSING FACILITY BEDS AT THE HANCOCK COUNTY FACILITY, AND THE ESTABLISHMENT OF NOT MORE THAN TWENTY NON-MEDICAID BEDS AT THE NEW HARRISON COUNTY FACILITY; TO PROVIDE THAT THE CERTIFICATES OF NEED FOR THE NON-MEDICAID NURSING FACILITY BEDS SHALL BE SUBJECT TO THE CONDITION THAT THOSE BEDS SHALL ALWAYS BE NON-MEDICAID BEDS OR THE DEPARTMENT WILL REVOKE THE LICENSE OF THE FACILITY THAT VIOLATES THAT CONDITION; TO DIRECT THE STATE BOARD OF HEALTH TO DEVELOP AND MAKE CERTAIN REPORTS AND RECOMMENDATIONS TO THE LEGISLATURE REGARDING THE STATE HEALTH PLAN AND THE CERTIFICATE OF NEED PROCESS; AND FOR RELATED PURPOSES.
